Do I need an attorney to sell my house in Illinois?

Yes. Illinois is an attorney-review state, and state law requires a licensed attorney to draft the deed and transfer documents for any real estate sale. This applies to FSBO transactions just as it does to agent-represented sales.

What documents do I need for an FSBO sale in Illinois?

At minimum, you’ll need a real estate purchase contract, a deed, a bill of sale, a seller’s disclosure, and various transfer tax forms. Depending on your municipality, additional local requirements may apply. We prepare and review all of these for you.

How much does an FSBO attorney cost in Illinois?

No. In Illinois, title companies are prohibited from drafting the deed and accompanying sale documentation. A real estate attorney can prepare these documents. The title company handles the title search and insurance; the attorney handles the legal paperwork.
